1.1. Seller – A legal entity MB "Gintaras sveikatai", company code 306128910, whose goods are sold on the website www.amberforhealth.lt according to these Rules and who is responsible for fulfilling the Buyer's order.
1.2. Amberforhealth.lt – A website located at www.amberforhealth.lt, where the Seller's goods are sold and which is administered by the State Enterprise "Registrų centras" of the Republic of Lithuania, a private legal entity registered in the Register of Legal Entities MB "Gintaras sveikatai", company code 306128910, correspondence address Malūnų g. 6B-1, Palanga. In these Rules, Amberforhealth.lt is understood as the Seller concerning the goods it sells.
1.3. Buyer – 1) a capable natural person, i.e., a person who has reached the age of majority and whose capacity is not restricted by court; 2) a minor between fourteen and eighteen years old who has the consent of parents or guardians, except in cases where the minor independently manages their income; 3) a legal entity.
1.4. Parties – The Buyer and the Seller together.
1.5. Personal data – Any information about a natural person whose identity is identified or can be identified (data subject); a natural person whose identity can be identified is a person whose identity can be directly or indirectly identified, particularly by an identifier such as name and surname, personal identification number, location data, and online identifier, or by one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
1.6. Rules – These "Amberforhealth.lt Goods Purchase-Sale Rules" which apply to each Buyer's purchase on Amberforhealth.lt and each Purchase-Sale contract concluded between the Buyer and the Seller.
1.7. Account – The result of the Buyer's registration on www.amberforhealth.lt, which creates a personal Buyer account storing their personal data and order history.
1.8. Privacy Policy – A document approved by Amberforhealth.lt that outlines the main rules for collecting, accumulating, processing, and storing Personal data when using Amberforhealth.lt. The privacy policy of Amberforhealth.lt does not cover the processing of Personal data by the Seller. The processing of Personal data by the Seller is conducted according to the Seller's policy. Before purchasing goods and concluding this contract with the Seller, the Buyer should carefully review the Seller's data processing policy.
1.9. Contract – The respective Goods Purchase-Sale contract concluded between the Buyer and the Seller, which is considered concluded from the moment of Order confirmation, i.e., the order submission moment. Each Contract concluded between the Buyer and the Seller is considered to have identical terms to these Rules and is always executed according to these Rules.
1.10. Order – An order for goods in which the Buyer specifies the goods they wish to purchase from the Seller, indicated in the same order.
2.1. These goods purchase-sale rules (hereinafter – Rules) are a binding legal document for the Parties, which establishes the rights, obligations, and responsibilities of the Buyer and the Seller when the Buyer purchases goods in the online store.
2.2. The Seller reserves the right to change, amend, or supplement the rules at any time, considering the requirements set by legal acts. The Buyer is informed on the website of the online store. The Rules in force at the time of order submission apply to purchases in the online store.
2.3. The right to purchase in the online store is given to:
2.3.1. Capable natural persons, i.e., persons who have reached the age of majority and whose capacity is not restricted by court;
2.3.2. Minors between 14 and 18 years old, only with the consent of parents or guardians, except in cases where they independently manage their income;
2.3.3. Legal entities;
2.3.4. Authorized representatives of all the above persons.
2.4. By confirming the rules, the Seller also guarantees that the Buyer has the right to purchase goods in the online store based on rule 2.3.
2.5. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer forms a cart of goods in the online store, indicates the delivery address, chooses the payment method, reviews the Seller's rules, and clicks the "Confirm Order" button (see section 6 "Goods Ordering, Prices, Payment Procedure, Terms").
2.6. Each contract concluded between the Buyer and the Seller is stored in the online store.
3.1. The Buyer can order goods in the online store by:
3.1.1. Registering in this online store – entering the data requested in the registration;
3.1.2. Not registering in this online store.
3.2. By ordering goods in the ways specified in rule 3.1, the Buyer must provide the personal data necessary for the proper execution of the order in the respective information fields presented by the Seller: name, surname, delivery address, phone number, and email address.
3.3. By confirming these rules, the Buyer agrees that the personal data provided in point 3.2 will be processed for the purposes of selling goods and services in the online store, the Seller's activity analysis, and direct marketing.
3.4. By agreeing that the Buyer's personal data will be processed for the purpose of selling goods and services in the Seller's online store, the Buyer also agrees that informational notices necessary for order execution will be sent to the email address and phone number provided by the Buyer.
3.5. The Buyer, registering in the online store and ordering goods, undertakes to protect and not disclose login data to anyone.
4.1. The Buyer has the right to purchase goods in the online store according to these Rules and the procedure established in other sections of this online store.
4.2. The Buyer has the right to withdraw from the goods purchase-sale contract with the online store by notifying the Seller in writing (email, indicating the item to be returned and its order number) no later than 14 (fourteen) working days from the day of delivery of the item to the Buyer. The Buyer can return the goods to the Seller in accordance with the "Retail Trade Rules" approved by the Government of the Republic of Lithuania on July 22, 2014, No. 738, and the provisions of the Civil Code – goods sold according to consumer purchase-sale remote or non-commercial premises contracts are returned under the procedure established in Articles 6.228(10) and 6.228(11) of the Civil Code.
4.3. The right provided for in rule 4.2 can be exercised by the Buyer only if the item has not been damaged or its appearance has not substantially changed, and it has not been used.
4.4. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.
4.5. If the Buyer's registration form data changes, the Buyer must update them immediately.
4.6. The Buyer undertakes not to disclose their login data to third parties. If the Buyer loses the login data, they must immediately inform the Seller using the contact means specified in the "Contacts" section.
4.7. By using the online store, the Buyer agrees to these purchase-sale Rules and undertakes to follow them and not violate the laws of the Republic of Lithuania.
5.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the online store.
5.2. If the Buyer tries to harm the stability and security of the Seller's online store or violates their obligations, the Seller has the right to immediately and without warning limit or suspend the Buyer's ability to use the online store or, in exceptional cases, cancel the Buyer's registration.
5.3. The Seller undertakes to respect the Buyer's right to privacy regarding personal information belonging to the Buyer, as specified in the online store registration form.
5.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
5.5. The Seller has the right to cancel the Buyer's order without prior notice if the Buyer, choosing the payment methods specified in rules 6.4.1 or 6.4.2, does not pay for the goods within 3 (three) working days.
6.1. The Buyer can purchase in the online store 24 hours a day, 7 days a week.
6.2. The contract begins to take effect from the moment the Buyer clicks the "Confirm Order" button, and the Seller confirms it by sending a confirmation email to the email address provided by the Buyer.
6.3. The prices of goods in the online store and in the formed order are indicated in euros, including VAT.
6.4. The Buyer pays for the goods in one of the following ways:
6.4.1. Payment using Paysera banking.
6.5. The Buyer undertakes to pay for the goods immediately. Only upon receipt of payment for the goods, the formation of the goods shipment begins, and the delivery term of the goods starts to be counted.
